Marriage future planning

Post by Tyfoon » Fri Dec 08, 2017 11:39 am

Hi all,
I am looking for help and some information!
I am an EEA Member living in the UK over 9 years now. This year (2017 aug) I have been naturalised as a British citizen. I am holding dual citizenship (British - Hungarian). This year I purposed my girlfrend. She is also an EEA member (Hungarian) still living in the country. We are planning that she coud moove to the UK in the end of this year.
We woud like to get married. We are looking for some advice what to do where to get married in the UK or in Hungary? What are the regulations?
We are planning to have children.
The new born is going to be British? Can the children get british citizenship even if they ar born in Hungary?
At the moment we are looking for the most suitable solution for our future!
Thank you for the help!

She can obviously enter the UK freely. To marry in the UK, you both need to attend an HO approved Registry office and give 28 days notice to marry.
We are planning to have children.

Yes the children will be British.
If born in the UK, they will be British otherwise than by descent, meaning they can pass their citizenship onto their children if they have children outside the UK.
If born in Hungary, they will be British by Descent, meaning they cannot pass their citizenship on to their children if they have children outside the U&K.

Thank you for your answer.
I am reading lots of things on government website and I am a bit confused now. Does it mean that because I was naturalised I am British citizen by descent?!
What is going to happen if she cant move before Brexit?

Hi all,
thank you for the help so far :) ! I was reading trough all these regulations and guidelines and I am still confused!

So if I understand because I am naturalized I fall in the group "otherwise than by descent". Is that correct?

If my children are going to born in the UK I can register them and claim the citizenship for them. Do we need to be married? Or that does not affect this?

If my children are going to born outside UK I can still register them and claim the citizenship? Or there are any exemptions?

Thank You

Correct

They are automatically British and can apply for a passport directly. No need to be married.

They will be British by descent and can still apply for a passport directly.

Not sure what you mean by 'register' in the last two questions.

Hi,
thank you for your quick response.

I thought after birth we need to register them at Home Office. I did not know I can apply for a passport directly after birth!

No you don't as they will be automatically British. However, if the child is born abroad, it is useful to register their birth with the British embassy/consulate as well.

Exactly what CR001 has been saying. If your children are born in the UK, all you do is register them with the council to get birth certificates (council where birth took place is preferred) and use one of the long form birth certificates to apply for their British passport.
