Tier 2 General to ILR (5 years)/ Tier 2 spouse visa

Dear All,

I need bit of guidance from experience people who have gone through this type of immigration challenges.

I am currently living in UK on Tier 2 General visa (sponsored by employer) and my Mrs is on Tier 2 spouse visa. I am completing my 5 years of Tier 2 General visa soon and I will be eligible to apply for ILR. I have few question prior to start filling the application form and would be great full if you can help.

My quires are;

1. What will be the correct form to apply and do I need my bank statements maintained for last 6 months?

2. My Mrs current spouse visa is valid until 2019, so if I switch to ILR from Tier 2 what will happen to my Mrs visa? do I have to apply a new visa for her as ILR spouse or can she continue until 2019 on her current visa? and if she continue on her current visa what type of visa she has to apply for extension and how long she will have to wait until she can apply for ILR.

1. Set(O) for ILR. No maintenance requirement but you must meet the minimum salary requirement of £35,000pa with payslips and bank statements to prove it.

2. She is not on a 'spouse visa', she is on a PBS Dependent visa. They are two different visa categories. If you apply for ILR based on 5 years residence Tier 2, she continues on her existing visa and extend her PBS Dependent visa if necessary until she qualifies for ILR.

Thanks for your quick and detailed response that's really useful to know. I will get this checked in more detail and will proceed accordingly. will keep on posting updates just in case anyone else finds this helpful as well.
