Applying for a new US passport in the Uk due to name change

Post by Robstin2014 » Thu Dec 14, 2017 11:26 am

Hi,

Just wanted a bit of guidance as to how I could get my partner a new US passport after her last name changes due to marriage.

I just thought it would be wise to ensure that she sends her new passport in the application for her spouse visa.

Is there anything I need to be aware of in terms of updating information or any affects this may have on her current tier 4 visa.

Many thanks.

She should contact the embassy regarding her passport.

She would also have to inform HO that her name has changed and update them with her new passport details etc.

How exactly would you inform the Home Office of the changes of details?

Why not just include the current passport with the Marriage Certificate when applying for the Spouse Visa?

Is that not sufficient?

Eager for guidance on this as my new wife and I will be applying for FLR(M) soon as we married the other day. We had hoped to provide her current passport with her "old" name and include our Marriage Cert.

As the new visa will be issued in the same name as the foreign passport.

Sorry to go on a bit of a tangent but in my experience, name changes are a costly (albeit essential) affair with the Home Office esp when you are here on a time limited visa.

Also, make sure your partner keeps a valid up to date US passport as Americans cannot travel back to the US on any other passport.

Is it a problem if the FLR(M) visa is issued in the US passport with the unmarried name?

What difficulties does this bring when the married name which is shown on the Marriage Cert is not the same as the passport or, if agreed and issued, FLR(M) Visa?

Are you saying a new passport should be ordered with the new marriage name before submitting the FLR(M) application is made?

Is it a problem if the FLR(M) visa is issued in the US passport with the unmarried name? No. There is no legal requirement for a married woman to change her surname and many don't.

What difficulties does this bring when the married name which is shown on the Marriage Cert is not the same as the passport or, if agreed and issued, FLR(M) Visa? No issue.

Are you saying a new passport should be ordered with the new marriage name before submitting the FLR(M) application is made? Yes

Thanks for the reply but it seems a little contradictory.

There is no issue with submitting the current passport in the name of Smith along with a Marriage Cert with the married name of Jones but a new passport in the name of Jones should be ordered before submitting the FLR(M)?

Grateful for some clarification.

You really should continue your questions in your own topic rather than taking over the original posters thread with ongoing questions.

There is NO legal requirement to change the surname. If the passport is NOT changed to married surname, FLR(M) will be issued in the maiden name as it appears in the passport. If she wants her married name on her visa etc, then she must first change the passport.

Thanks for the clarification and apologies to the OP and you for the high-jack.
