FLR(M) Application from Fiancé Visa.

Post by samq » Thu Dec 14, 2017 5:59 pm

Hey guys, I need some help. I'm new here but have been reading this forum since quite some time.

I applied for a Fiancé Visa in November 2016, and it was initially refused, as my Sponsor wasn't able to receive the verification call from the Home Office as she was with me in Oz and also we messed up some details and stuff. Later on, we Appealed for and got the visa in August 2017.

I had to resign from my Employment, and arrived to the UK at the beginning of October. We got married in the UK at the end of October, and now we're about to submit our Postal Application for FLR(M).

I have a few questions, as I've found conflicting answers on several places, and am really confused.

1- Firstly, I would like to ask if we should go with the Postal Application or the Online Version?

Now the questions concerning the FLR(M)

2.2 Is this the first time you have applied for a visa or extension of stay in one of the above categories (including previous leave to granted as a fiancé(e) or proposed civil partner) with your current sponsor?

I've checked No as I've just arrived to the UK on a Fiancé Visa. Although I've read conflicting statements, as some people, despite of being on a Fiancé or Spouse Visa some answer to this question as a yes.

Next, I've checked First period of leave to remain (following an initial period of entry clearance.........

3.9 How long has your sponsor lived in the UK?
She's been born in the UK, but spent 2 years of her life in Denmark, 2 years of her life in Canada, 1 year of her life in New Zealand, and 4 years of her life in Australia.
Should I mention the time she hasn't spent in the UK? As that does account at least 1/3 of her life. She has lived in the UK for quite a long time too (over 17 years) and has currently been residing and working there since the past 4 years.

I've answered - Since Birth - (DOB)

3.11 How long has your sponsor lived at this address?
As soon as I entered the UK, we purchased a new property within 28 days and moved in together, as earlier she was living jointly with her parents since the past 4 years.
I've entered 2 months and 13 days. - Should I round this off to 3 months or 2 months? or is this fine?

5.3In what category were you granted permission to enter the UK?
I was refused a Fiancé Visa and got it visa Appeal. My passport states, "Leave to Enter Outside of the Rules"
I've entered the answer to this as On A Fiancé Visa - After Appeal

Section 6 - Details of our relationship

6.2 When did you first meet your Sponsor?
6.3 Where did you first meet?
6.4 When did your relationship begin?

I met my Sponsor 8 years back, but only as friends. We started dating 16 months after we first met in Tuvalu. I've mentioned all that in my Fiancé Visa Application with evidence, and stuff
Should I answer in detail with pictures and evidence of our first meeting and when we started to date? I've just written a one word answer for all of these. 6.2 August 2009, 6.3 Funafuti, Tuvalu, 6.4 December 2010 - Is this enough? Or should I go into details with supporting evidence such as pictures and meetings attached?

6.5 How do you keep in touch with your sponsor?
As we're married, I don't know how to reply to this one. We live together in the same house, which we've purchased and is on both of our names.
I've answered We live together and apart from that, we stay in touch using phone calls, signal, facebook messenger, & texts.

The most important and confusing question due to our complex case6.7 When did you start living together as partners?
We've lived together for nearly 1.5 years between December 2010 and August 2012, she had to move back to the UK in August 2012. I visited her 4 times since then and she has visited me 7 times in these past 5 years. Overall we've stayed together for 1.5 years at first, shared the same house, and later on during the past 5 years we have stayed with each other for at least 21 weeks.
To keep it simple, I have answered October 2017 - Since I entered the UK Should I go into the old details? During the past 2 years, we haven't really stayed together for that long. We stayed together for only 5 weeks in total. Plus our confusing past really could complicate things.

6.8 Add all addresses you and your Sponsor have lived at in the 2 years preceding this application if you have lived at your current address with your Sponsor for less than 2 years?
We just got married in October! Should we still include all our past addresses? During the past 2 years we stayed at 6 different hotels, in 4 countries. Plus our home addresses - that makes it 8!
I've just given the address where we stayed for together since I arrived to the UK - XXXXXX From 2.10.2017 to 30.10.2015 - No previous addresses!

6.30,6.31,6.32 What languages do you speak well?, your sponsor? and our communication?
I speak 2 languages, and she speaks 5. Should we mention all? We communicate in English mainly & sometimes Italian?

6.33 Do you and your Sponsor have shared financial responsibilities?
We own the Property, so no mortgage or rent. So Council Tax and Electric/Water/Gas Bills?I've answered Electricity, Water & Gas Utility Bills and Council Tax Should I mention the figure as well?

7.12 How many other rooms are in the Property (NOT including Spam bathrooms and toilets?
We have a 4 bed property, and have a dining room and sitting room separate apart from the bedrooms - that's two. But the main question is, we have a huge entrance room, with open Spam. That room is larger than our sitting room/dining room combined. Should I write 3 rooms? Or just 2?

Thanks for everyone in advance for helping us out!

Cheers,
Sam

Firstly, you should try ask questions in smaller chunks/posts. Members are often put off by such long lists of questions.
1- Firstly, I would like to ask if we should go with the Postal Application or the Online Version?
The forms are different so if you ask questions, we can only see the paper version and not what you see online. It is your choice which you choose to use. The paper form is not only for postal, it can be used for in person same day applications too.

Next, I've checked First period of leave to remain (following an initial period of entry clearance.........[/quote]
Tick the first block on page 12 of the paper form.
You can simply write 'since birth'.
Fine to write 2 months 13 days.
5.3In what category were you granted permission to enter the UK?
I was refused a Fiancé Visa and got it visa Appeal. My passport states, "Leave to Enter Outside of the Rules"
I've entered the answer to this as On A Fiancé Visa - After Appeal
Should be fine.

Or should I go into details with supporting evidence such as pictures and meetings attached?
No need for pictures and evidence of meetings. Simply answer the questions honestly with the relevant information as asked.
6.5 How do you keep in touch with your sponsor?
As we're married, I don't know how to reply to this one. We live together in the same house, which we've purchased and is on both of our names.
I've answered We live together and apart from that, we stay in touch using phone calls, signal, facebook messenger, & texts.
Bold underlined is fine.
You are overthinking this. Simply state October 2017 if that is the case.
Simply state the current address. Note that the form is used form a variety of applications as a spouse. Some questions are less relevant to your circumstances than others.
6.30,6.31,6.32 What languages do you speak well?, your sponsor? and our communication?
I speak 2 languages, and she speaks 5. Should we mention all? We communicate in English mainly & sometimes Italian?
List them all as the questions ask.
No need for figures, simply state yes and list them.
Or just 2?
Simply state the number of extra rooms. Entrance halls are not usually considered a 'room'.
