what happens to my old BRP

Post by Ricardo20 » Mon Dec 18, 2017 9:43 am

These questions are needing answers for my wife:

1. We will do a "new, 30 day entry corridor" on my open "Settlement visa", so we will ask my Vignette Transfer for new dates of entry (we do this because I could not enter the UK in during the 30 days granted to me, because of my mother's serious illness, for which I must take care until she is cured.) We will write an explanatory accompanying letter and attach a certificate from the doctor.
Q: Will they give me a new BRP? If it is, then on what date? Will it leave the old dates that were given from November 1, 2017 to August 1, 2020, or will they give new dates, due to the new terms of entry for Vignette Transfer?
2. Question: If old dates are left on my BRP, then how will we be in the future with obtaining my permanent residence? We will miss the months that I spent outside the UK, because I did not move, due to my mother's illness, to the first 30 days I received. Can we pay for these missing months and then apply for permanent residence, or do we have to apply for a third wife's visa?

Are you able to help answer any or part of the questions? Thank you if you can help.

1. You will get a new visa vignette of 30 days and then still required to collect your BRP card when you arrive in the UK. Likely the same date as originally.

2. If you are short to complete the 5 years residence requirement, you will require an extra visa extension to make up the shortfall.

3. You cannot 'pay for the missing months'. She will need to apply for a 2.5 year extension if she has a shortfall in the same way as the second extension she does after 2.5 years.

If I reply within the 2.5 years the visa is valid for, is it true that I will not need a new visa application, just the extension? For instance, if I applied one year after the visa was granted, is it true that if I had not contacted the home office within this period, I can still apply for an extension even though a year has passed?

Yes, you can apply for an extension.

I would just like to clarify as different solicitors are telling me differing things. One of them said that my old BRP will be disposed and discarded.
What I am trying to ascertain is that when I go to pick up the new BRP with my wife, will it have a new date on it or are you saying that it can go either way. For instance it may have the same date or it may have a new date. What can you tell me please.

You were granted a visa for 2.5 years (possibly 33 months). The 30 day visa is only to facilitate entry to the UK. Transferring this to a new 30 day visa does not change your 'visa issue and expiry' date, which you have already been granted, as far as I understand.

Yes, I understand that you are correct in the 30 day vignette is just for entry purposes and a new one can easily be issued. However, my question is as the BRP at the post office may possibly be removed and withdrawn according to some solicitors, will the new BRP which is put into place consist of the same dates even though my vignette in the passport is for about a year later.
I apologise if I was not very clear before in asking my question.
