ILR application for dependant of Tier 2: 5 year route

Post by Rupinder1982 » Wed Dec 20, 2017 1:23 pm

Hi

Need some advise regarding ILR application for my wife.

Time lines:

1. I entered UK in June 2012 on Tier 2 General.
2. My wife joined me as a dependant on this visa in Feb 2013 (it was granted then).
3. Since then I have had 2 more visa changes (all Tier 2 General) from within UK and we had switched my wives visa as well each time as Tier 2 dependant (with the new sponsor).
4. I completed my 5 years this year and I have been granted ILR in Sep 2017. While my wife is still on the Tier 2 Dependant (valid till Feb 2018).
5. She will complete her 5 years as the Tier 2 Dependant in Feb 2018 and we are planning to apply in January 2018.

Question is:
a. Do we need to apply on Set (O) or Set (M)?
b. If it is Set (O) then would she go on as the main applicant? and what about the other requirements like employment letter etc (as she is not currently working).
c. If it is Set(M) then I was not sure about the financial requirements as it asks for £18,600/year, not sure what it means? Do we need to have that much savings or is it something else?

Many thanks for helping out.

Regards

a. Set(O) if she is on PBS Dependent visa.

b. She is the main applicant as she is the one applying for ILR. No employer letter or absence letter required.

c. Not relevant.

Sorry forgot to ask.
She is not working and wouldn't have any payslips.
In the section 5 of Set (O)
"5.4 Does a relative or friend of you or
your partner, or both of you, regularly
give you money?"

Do I just give a figure? We use a joint account and all the money goes in there

Simply complete the form honestly. If you share a joint account, then state it.

Sorry about putting the personal info in the other, I wasn't aware of that.

Reading through other post I think ILR for PBS dependent is straight forward and just wanted to ask that is it a requirement to provide documentary evidence that we have been living together for 5 years, just because some people have included a very extensive list of documents proving that they were living together and I don't have such documentary evidence.

Evidence of cohabitation for the 2 years immediately before applying for ILR.
