Administrative Review and Applying for another visa

Hello,

I've just recently applied for an Administrative Review of my Tier 2 visa application. I'm still waiting on the outcome of this, but want to to be prepared if it's declined. If it's refused, I was told I have 14 days to submit a new visa application. If I have to make a new application, do I use the same healthcare surcharge I used in my previous application and do I have to re-submit my biometric information again? Is my legal status in the UK protected as soon as the application goes in? I think I would have to get the 10 day priority service if I only had 14 days ? Many thanks for any help

No, you have to pay again and get a new IHS Number. Your previous IHS will be refunded if your AR is unsuccessful.

Yes
Is my legal status in the UK protected as soon as the application goes in?

No, your Section 3C protection ends when your AR is unsuccusseful. You would need the next application to be approved for the overstay to be ignored for ILR.

Thanks very much for your reply. Original application was refused because it had the wrong salary on my CoS which didn't meet the minimum requirement. So not expecting AR to be successful really, so just getting prepared. The Home Office still has my passport and all my documents, so I assume I don't have to add any additional info detailing this as surely they would realize why those are not enclosed?

Right so administrative review was refused. Letter was dated Dec 22nd, says will count 2 business days after letter date as beginning of 14 day period to either leave the country or inform reason to stay I'm in process of trying to organize with lawyer and employer to do a priority postal application. With the holidays, Dec 28th would be the 2 business days I think, so I have until Jan 11th? For my new application, does anyone know what start dates for my job should be as I'm in the same job. Would mid Jan be reasonable? Thanks for any help.

If the employer has to request more CoS allocations how long does this normally take and can you request an urgent CoS?

How long did it take them to reply to your admin review?
