ILR for my wife

Post by khan81047 » Wed Dec 27, 2017 5:51 pm

Good evening guys,
Please help me out with your expert guidance and advise.

I will be eligible for ILR on 10 year basis in Jan 2018, also will apply for my childs British passport as soon as I get my ILR (child was born in UK and currently does not have a passport). I have been dependent on my wife since 2011 (got married in UK in 2011) and she will qualify for her ILR in Aug 2018 on 10 year route. My query is
1. Can my wife apply for her ILR as soon as I get mine in jan 2018?
2. if she can, what category can she apply and what form needs to be filled?
3. Will getting a British passport for my child help her in her ILR application?
4. Is it advisable to wait until she qualifies for ILR based on her 10 year route?

I would like to appreciate you all for your help and time

Thank you

1. No.

2. Not relevant.

3. No.

4. Yes provided she meets all the requirements.

There is no shortcut because you get ILR.

1. under which category can we apply for her
FLR(M) spouse visa. It will be a new 5 year route (2 x 2.5 year visas) before she will qualify for ILR based on 5 years residence.
2. is there any maintenance of funds to show
No.
3. does it require me to have certain salary
You need to prove you meet the minimum income requirement of £18,600pa (assuming you have no children). Either of you can prove income if she is applying to switch within the UK.
4. what is the policy guidance (if you can forward the link for it please)
FLR(M) Guidance Notes
5. which form needs to be filled
FLR(M) Form
