ILR for Tier 1 dependents - 2 year route issue

Post by bips » Wed Dec 27, 2017 7:02 pm

Hi Friends, please could anyone help me with my issue.

I hold ILR under Tier 1 general route and already eligible for British citizenship.

My wife and son initially came to UK with me as my dependants under Tier 1 general ( Date of first entry 02/10/2010). However, they had to go back due to family reasons and joined me again on 06/06/2014 as my dependents ( had to re-do the visa since the first visa expired after 2 years). we are living in UK from 06/06/2014 with only minimal holiday absence from UK. (had to extend the visa once while we are here and current validity is until January 2019). I was under the impression that my wife and son are eligible for ILR now through the 2 year continues residence route (since the date of first entry is 02/10/2010) , but getting conflicting advise here , also i can't see any reference on the 2 year route on latest SET(O) form that I could see before.

Are they still eligible for the 2 year route since they first landed as Tier 1 dependant in 2010 ?.
Or are they not eligible since they had a break and came again in 2014 ( 5 year route) and need to wait until 06/06/2019 ? (2004 + 5years).

Your expert advice will be highly appreciated. I am worried I may lose 5.5k if I apply now .
Many Thanks,
Bipin

What date did their initial dependent visa expire when they were outside the UK and on what date did they apply for a new entry clearance visa as Tier 1 dependent (exact dates for both please)? What date did they leave the UK?

She will qualify for ILR in 2019, 5 years after the date of entry to the UK in 2014.
