I wonder someone can help here.
My wife was granted her first visa on 18th feb 2013 as tier 1 general partner, for 2 years
She then had extension along with main applicant on 13-1-2015 for another 3 years.
Now her visa is expiring on 13-1-2018. Technically we have had 5 years of visa and eligible for ILR.
Reading online, it’s states applicant must have 5 years residence prior to applying for ILR. IT also states that application can made 28 days before the expiry date.
In summary, her total residence has been short of 34 days in 5 years.
What should be our next step ? Can we apply for ILR ?
Would really appreciate any support or guidance that could be offered.

For pbs-dependants ILR qualifying time starts sfrom the date of entry not the date of issue

Yes, when you vary then you can ask for refund2) will that fee be refundable when we vary application?
Yes, but before you even get the biometric you'd have completed the time required. It takes 1-3 week to get biometric3) in extension application , once we recieve the biometric and I assume it will have 10-14 days for completion, do we hold on doing that or complete the biometric and send the info back and then Vary the application.

When you vary you have to wait for ome office to accept your variation. They already would have all the documents. Google yo'll find alot of threadsAdditionally, all the documents that are sent with extension application (Ie original passport, biometric card, kids birth certificates, marriage certificate etc), would I just have to make a reference in the letter to advise the home office of that?
