180 days Rules

Post by M Pasha » Sun Dec 31, 2017 6:54 am

Hi, good morning to all. I hope everyone is doing amazingly well apart from me. I am seriously desperate to know about the following -

First entry UK 26-Jan-2008

Outside UK 30-Jan-2012 to 22-Feb-2012

longest stay outside UK 31-Dec-2013 to 08-May-2013 (128 days with a valid visa)

altogether 151 days.

Does it means I am not eligible for ILR. I have booked Premium service on 4th for SET(LR). Please advise me if I have done anything stupid at the last moment. Your precious knowledge and guidance would be a great help. Many many thanks.

best regards

Its 180 days per years not in 10 years. As long as you have not had 180 days out of the UK in any single year you are fine.

But to confirm please provide complete immigration history for each year with type of visa you held and days outside the UK

Dear Makky86,

Many thanks for your kind reply. Here is my immigration background,

2008- 2011 (T4 Student)
2011 - 2013 (PSW)
2013 - 2015 (T4 Student)
2015 - 2017 (T4 student)

However, I have applied for FLR(IR) before my T4 expiry date. I have applied based on army job acceptance. Since then I have no updates from the HO. Now I have also cancelled premium service for 4th Jan, 2018. Please advice me what to do or if I am eligible now to apply for ILR or not. Many Many thanks

best regards,

Then you can vary your application to ILR SET (LR). Information is here

https://www.gov.uk/government/publicati ... procedures

ON what basis you applied FLR ? If this was just to buy some more time CW can even refused your LR ILR

Many thanks for your time and reply.

I passed army job assessment but the phase 1 joining date was after my T4 expirity. Therefore army recruitment team suggested me to apply for a new visa. Once i will get the visa i can join the phase 1 training. that's why i had to apply for FLR not to buy time. The job is open for me upto 2 years.

I hope you understand the situation. As i have cancelled my premium service now (stupidity) , should i just just send SET (LR) directly ?

Many thanks

Since your application is already pending you need to vary to SET LR directly.

Not a mistake. even if you appeared the application would have been gone to hold anyways since they have your original passport.

Have you already canceled the appointment?

You won't get a full refund if you do it less than 5 working days before the appoinment.

The appointment was on 4th Jan 2018. OP has cancelled today so OP will only lose £100. The rest will be refunded

Appointment was booked on 29th Dec and I accidentally cancelled it today (while i was reading cancel process).

I have emailed them already regarding the incident. Hope they will consider my case. I am doing all these mess last moment.

I hope they will consider a full refund however i don't mind if they deduct the £175. Again super thank you both of you. It means a lot in this crisis.

Best regards/

I am only concerned about the weekends and public holidays issues.

Also it was not part of any existing online application. So I believe I am safe losing that cash
If you booked as part of your online visa application
You can reschedule your appointment by logging in to your application.

You must withdraw your application to cancel your appointment if you booked it as part of your online application. You’ll need to apply again for a new appointment.

You won’t get a refund if you withdraw your application. Please let me know if I am right. cheers.
