Visa After Leave to Remain

Post by Jayeds2014 » Wed Jan 03, 2018 1:54 pm

Hello Everyone,

I am new in this forum and i got some questions which you might help😊

I am a naturalised British Citizens, My husband got a spouse visa for 2.5 years which expires this November 2018
I am quite confuse if I need him To extend his visa using FLR (M) or apply for SET (M) for ILR as I read he falls under the 2 year route? Correct me if I am wrong.

If I will apply for the FLR (M) is his A1 certificate be still be valid? And does he needs to take the LIfe in The UK test?.

I would appreciate if you can enlighten me with this query. Thank you very much😊

How long has he been on the spouse visa?

Why do you believe he comes under the 2 year route? How long has he been on a spouse visa? What is his immigration history?
If I will apply for the FLR (M) is his A1 certificate be still be valid?
You need to answer the questions above. If he has only had one 2.5 year visa, then he needs English A2 for an extension.
And does he needs to take the LIfe in The UK test?.
LIUK is ONLY for ILR and not for FLR(M) visa extensions. But again, your post is vague and not clear on the immigration history.

Hello thank you for your response.. As stated in his letter he's spousal visa starts last 21 Feb 2016 and expires on 21 November 2018. Im quite confuse about the 5 years and 10 years route?

Do I need him to apply for an extention of his spousal visa? So He can qualify for the 5 yrs requirement of ILR?

Thank you

Presumably this was issued outside the UK. On what date did he enter the UK on a spouse visa?

Yes, for another 2.5 years on form FLR(M).
So He can qualify for the 5 yrs requirement of ILR?
Yes. There is no longer a 2 year route, it ended in July 2012. The 10 year route is if an applicant does not meet the financial requirement.

He should apply for an extension as close to 2.5 years residence as possible.

He will then qualify for ILR on Set(M) within 28 days before 22nd February 2021.
