Indefinite to remain/PR

Post by Nassbel » Thu Jan 04, 2018 2:37 pm

Hi all ,
My 5 years eea family member will end on the 23rd of may 2017 so the next step should be applying for the indefinite to remain , I am married still & working full time
My questions are :

*When can I apply ?
It says the earliest i can apply is 28 days before the expiry date of my 5 years ! Is it true or is there any way I can apply earlier ??

*Why I have seen cases with a couple of people that applied for the indefinite but end up receiving another 5 years ???
What is this case and what is the difference

Any detailed answers would be so helpful as I am kind of worried

Regards
Nacer

You don't qualify for ILR under the UK immigration rules if you hold an EEA residence card. What is your relationship to your EU sponsor?

For PR under the EEA/EU rules, there is no '28 days before' concession. You need 5 years residence from date of marriage OR date of entry as a spouse of EU citizen OR from date of residence card if you are an extended family member.

Usually when they don't meet the requirements for ILR. Unless you can post a specific link to any cases you have seen on the forum, we cannot comment.
