ILR Applicant With Tier 2 Dependent

Post by nkinawi1024 » Fri Jan 05, 2018 2:58 pm

Hi all,

My husband is eligible for the ILR in a few months through the 5 year route. I'm currently on a Tier 2 General Dependent visa based off his current visa, which is set to expire in May.

I was wondering - am I able to renew my Tier 2 Dependent visa with his ILR application, or do I have to wait for him to get his ILR and then renew my visa?

Any advise is greatly appreciated.

Thanks!

Is he applying in person at the premium service centre?

When does his visa expire?

If yes, then you can renew but you need your on separate appointment a couple of hours after his appointment. If his ILR is held or refused, your application will also fail.

Yes, he's planning on doing the premium service & his visa expires the same time mine does.

Fine then if you apply same day with your appointment after his.

Sorry - after doing some research, it looks like I may be eligible to apply to settle in the UK as the partner of a tier 2 holder who has settled in the UK (if he gets it).

First, is this visa the ILR?

Second, I'm slightly confused about the eligibility criteria, specifically the "You must have been living with your partner in the UK for at least 5 years if you applied for your current visa on or after 9 July 2012"

I did get my current visa after this date, however I will have been living with my partner in the UK 5 years in April (when I got my first visa - which was a student visa).

Does living with my partner, even if it was other visas, count? Or does the 5 years only count with a dependent visa?

Thanks!

No, you cannot combine different visa categories to make up 5 years. You must have 5 years as PBS dependent visa holder.

Did you miss the words "current visa" in the extract you quoted?
