Post by macmoh » Fri Jan 05, 2018 8:31 pm

Hi
I am considering applying for settlement for my mother. But not sure if that will be successful.
I am currently a phd student and just got my ILR 4 months ago. My mother lost her husband20 months ago and she is diabetic and 68 urs old. I just applied for a 2 yrs visiting visa for her.

Pls advise me.

Your mother doesnt qualify for ILR and it will almost certainly be refused.

If an Adult Dependent visa application is refused, this will close the door for a visitor visa in the future, due to the prior intention to settle. Only a handful of ADV applications have succeeded since the Immigration Rules changed in July 2012, and these have mainly been following an expensive and lengthy appeal.

You would need to show that your mother is unable to manage simple tasks on a daily basis, such as bathing, dressing, preparing food ect., AND that care is either not available in her home country or is unaffordable.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
