Date of Extension without effect on ILR...

Post by 9elizabeth » Sat Dec 23, 2017 5:32 pm

Hi all,
Date of grant of Tire 1 Ent Visa: 20 November 2014
Initial Entry Visa Valid till: 20 March 2018
Date I entered in UK: 26 December 2014

My questions are:
1) Can I apply for extension on January 03, 2018 (even if the visa expires on March 20, 2018
2) If the answer is YES to question 1, will I be able to apply for ILR on October 21, 2019 (28 days before completing 5 years from the date of initial entry visa)?
3) In your opinion, whats best: Apply extension 28 days before expiry of initial visa? (after 3 years 2 months) or apply as soon as one completes 3 years?

Thanks in advance.

You can apply 28 days before 20th November 2019, provided you meet the job creation criteria. The period between grant and your actual entry can be counted into the 180 days absence allowed each year. [/quote]

Does not matter too much. Just depends on when you have all the documentation needed.

Confusion on filing up Application Form

Post by 9elizabeth » Mon Dec 25, 2017 6:15 pm

Hi all,

I am just filing the application form for extension. I have a query:

On page No. 46, 2nd column of the table says " Start Date with your business (if this differs from start date in job)" and the 3rd column says "Start Date"

I think, the start date of the employee would come into 3rd column as "start date" but I am confused with the 2nd column. Can some one please elaborate what should I write in 2nd Column.

As it says, you only need to enter it if that date is different from the start date.
This caters for the case where your employee may have changed jobs (from Office manager to sales manager, for example) after joining your company. In such a situation the dates will be different

Thanks a lot. I understand now.

I have another question:
Line No C4 on Page No 8 of Form "Application for a Grant of Leave and Biometric Immigration Document as a Tier 1 or 5 Dependant" - What is the reference number for the most recent application of the PBS main applicant you are dependent on? (ht)

I do know the reference number. Is it the Tier 1 Ent visa (affixed on main applicant passport) number?

I believe it is the main applicant's previous application number. (I think this is not the Visa number from passport).

Quoting from the help text, it says that 'This number can be found on any previous Home Office correspondence relating to Tier 1 or Tier 5 migrant"

From the above quoted, my understanding is that it should be the previous application number. HO doesn't quote your visa number on correspondence but they do quote the application number.

I also believe that this needs to be same as what you are going to fill in the main applicant's extension application form (page 13, B11).

Do we need to have Self Assessment filled in?

Post by 9elizabeth » Sun Jan 07, 2018 8:52 am

Hi there,
I am just about to apply for extension for T1 Ent. visa. I been the Director of the company for last three years. But I never filed Self Assessment (because I neither I register myself for self assessment nor I received any notification from HMRC. On the recommendation of one of my friend, I called HMRC and register myself for Self Assessment last year. Thus, My first Self Assessment is to be filled in by January 31st, 2018.

My question is: do we need to file and provide the proof of Self Assessment along with Extension application?
Please advise.

This has nothing to do with the Tier 1 E rules directly.

But yes, you are supposed to have filed Self Assessment throughout.

Have you registered for online self-assessment :?:
(Casa, not CR001)

Please read the guidance and the application form notes properly.

Does it say you need to submit confirmation of Self Assessment ?

I haven't been able to see any such requirement under specified documents and I just don't understand why applicants keep wanting to submit more documents than needed when the application form clearly states (in pg 66)
You must be selective in submitting evidence, as sending large amounts of irrelevant or poor quality documentation may delay the consideration of the application. It is only necessary to submit evidence that is directly appropriate to the application as requested, as unrelated evidence cannot be considered for points scoring.

Here is another question:

I am filling up the form for T1 Ext. On page No. 8 of (Dependent Application Form) Question No: C4 , it asks: What is the reference number for the most recent application of the PBS main applicant you are dependent on?

I do not remember If I ever had any reference number from Home office. so far as I remember, I do not think, when initial entry visa was granted, the british embassy in india gave me any letter. What should I write there? or where can I get this reference number?

Or is it just the visa number. (when I got visa, NO bio-metric were provided and I only have visa affixed on my passport).

Thanks for your help

The visa number on the top right corner of the visa vignette.
Char (CR001 not Casa)
