Set(M) and he must not be living an independent life.

Is he leading an independent life?

ILR of over 18 child

Post by seemR » Sun Jan 07, 2018 8:38 pm

Hi
I am going to file spouse ILR visa application of my wife with my over 18 year old son in the same form. It says in the guidelines of SET(M) form that over 18 year old child can apply with mother, if they were under 18 when they first got visa in the same category. It also says we have to prove that over 18 child is not living independent life.
Can anyone PLEASE guide me as to what documents do I need to prove that my over 18 year old son is not living independent life

Hi

In the end, did you use the same SET(M) form for wife and over 18 child? Or did you use separate SET(M) forms for each of them?

We are in same situation as you were here- and I have seen/ heard various different advice on this.

To further confuse matters the SET(M) form says 'over 18 apply separately' but guidance implies over 18 dependant on previous FLR souse/ family visa can apply at 'same time' (which I am assuming means same form)!

Thanks
