If you obtained ILR based on 5 years residence with PBS visa, then your spouse can remain as a PBS Dep and she does not have to switch to FLR(M).a) Should i need to apply for FLR (M) for my spouse to change the visa category PBS dependant leave to remain. Currently, the PBS dependent leave to remain visa validity is until Mar 2018.As I understands, FLR (M) issues the visa with the duration of 30 months which would be until Jan 2018 if applying now which doesnt make much difference over the period of stay as both the types of visa can be extended presumably.
Makes no difference unless she is a doctor or dentist in training. Both visas are a 5 year route to ILR and both will require an extension. Only advantage I can see is that FLR(M) is a cheaper visa and you don't have the £18,600pa financial requirement to meet. What category of PBS Dep is she (Tier 1, Tier 2 G, Tier 2 ICT......)?b) If its an optional, do we have any advantages of being staying with FLR (M) issued visa over the PBS dependant leave to Remain visa when it comes to ILR application to be made in the future.
If she switches to FLR(M), she will have to start her qualifying period again from zero and wait 5 years from date of issue of FLR(M). She will need English A1 test certificate, you need to meet the financial requirements as well.c) If I am applying now for FLR (M) in case, would the period of stay over PBS dependant leave to remain be reset to 0 and fresh 5 years cycle starts from the date of FLR (M) visa issue?
