8 months short to complete 10 Years in UK (Long Residence Route)
Tier 4 Issued - 05/03/2011
Tier 2 General issued - 14/08/2014
Tier 2 General Extension Issued – 07/01/2018
Tier 2 Extension Expires on – 14/08/2020

Hi,
Could someone help me with below queries please as I was hoping to settle in the UK with 10 Year Long Residence route?
1. Am I eligible to work for the same Employer on a different SOC?
2. If so am I still exempted from the RLMT?
3. If nothing works could my partner join any college to do an under graduation or level 6 course where I apply as my partners dependent? (With this procedure will I still be eligible to apply for a 10-year route?
4. Is there any other Alternate option to complete this gap?

Looking forward to experts valuable Insight on this case.

No, you need to make a change of employment application. The Tier 2 guide sayas:
You must also make a change of employment application if you are remaining with the same employer but:

• there is a change to your core duties which means you change jobs and the new job is in a different Standard Occupational Classification (SOC) code to the one stated on your CoS. (This does not apply if the SOC Code for your new job has only changed because of reclassification within the SOC system by the Office for National Statistics)
2. If so am I still exempted from the RLMT?
No as a new SOC required, RLMT should be done unless your new job is on the shortage list
3. If nothing works could my partner join any college to do an under graduation or level 6 course where I apply as my partners dependent? (With this procedure will I still be eligible to apply for a 10-year route?
You can switch to the PBS dependent route if your wife gets a Tier 4 visa.
4. Is there any other Alternate option to complete this gap?
Well you can leave the UK before visa expiry and come back within 6 months with a new entry clearance. Your 10 years will be intact

Thank you for your reply. When you say leave the country and come back within 6 months before visa expiry with new entry clearance what fo you mean by that?

Hi ,
If my wife and kid leaves UK six months prior to their Visa expiry ,apply for Tier 4 visa from India and comes back to UK, Could I switch my visa as Tier 4 dependant before my Tier 2 expires and will I still be eligible to apply for ILR based on 10 years long residence? or do I definitely need to exit the country and come back?

That would work. You simply then switch to Tier 4 dependat within the UK without leaving

Hi,
Could I submit my UK Born child's ILR application once I get mine or will it reset's back to complete further 5 years if she exits the country with my wife and comes back as her dependent?

There is no option for a 'dependent' allowed to apply with you if you apply for ILR based on long residence.

They can apply on FLR(M) if they meet all the requirements.
