LR application with 3 breaks of more then 6 months(compassionate ground)

Post by baldev42patel » Fri Jan 12, 2018 1:35 pm

Hi
I hope you guys will help me and my daughter for my settlement visa on LR ,10 year route.
My husband and son(5 year born in UK) are both UK citizens. My daughter(10 Year born out of UK 2008)

****I have total 3 absences during 2007 to 2013 which is more then 6 months (around 800 days in 12 year.
(Reason for absences) My father in law who was serially ill and was on dialysis during my absence in UK.He was also partially blind and need my support as a carer during that time.He died in December 2015.I have various documentary evidence and video evidence to support this case.I had continuous visa since i first come in UK without any break.****

Details of visa history and personal circumstances.

1,I came in UK IN January 2006 as a student dependant for 3.5 year

2, 2 year post study work dependant.

3, 4.5 years PBS dependant.

4, before 5 year of PBS end my husband applied 10 year LR Visa and eventually got settlement and naturalisation and British citizenship in 2015.

5 ,At that time i could only apply FLR(M) visa because my husband got ILR ON 10 year route and which i did and now in 2018 I complete 12 year total in UK.A person who got settlement visa on basis on LR(10 Year route)his or her dependent have to apply saperatly for any ILR visa and not as a dependant of that person.

6,My husband and 2 children are in UK.My and my daughter's FLR(M) visa is coming to an end in March 2018 and thinking to apply ILR rather then extending another FLR(M) visa for 2.5 year.
7,Once i get my ILR my daughter can straight apply for naturalisation. So i want to apply first on premium service.

Friends i need your expertise and please let me know if there is any strong ground for ILR. Every little information will help me.

Thank you in advance!!!!

You can try but I think it will not be strong reason. It was not even your blood relative. I think ILR will be refused.

You can wait for gurus to repsond.

It is 540 days max in the last 10 years. You can ignore 2007 absences. However you cannot have absences of more than 180 days at all. In that case you must stay on FLR(M) until you can get ILR on that basis.

Do you mean once your daughter gets ILR or just you?

p.s. children are registered, not naturalised.

Your absences are excessive and break your continuity of residence on 3 occasions.

Taking care of your in laws does not count as a compassionate ground
