FLR(M) visa length 30 months or 33 months

Post by donblount » Sat Jan 13, 2018 10:01 pm

According to this page the FLR(M) visa could be given for 33 months. http://workpermit.com/immigration/unite ... erson-visa

Is this correct? My understanding is that the FLR(M) visa is for a period of 2.5 years, and one could apply for an extension for another 2.5 years before applying for ILR.

You've misunderstood. The initial Spouse Settlement entry visa is issued for 33 months.

FLR(M) grants 30 months, followed by a further 30 months extension for the second FLR(M) application.

If necessary, remind them to use discretion and add up to 28 extra days.

Looks like my spouse was granted visa for 31 months the first time. This is likely due to 28 days discretionary extension done by the case worker. I was wondering why the 33 month visa was not granted.

If the application was within the UK, then the maximum was thirty months plus discretionary 28 extra days.
If the application was outside the UK, then the maximum was thirty three months.

I was of the view that a person is issued with a 30days visa and upon entry they are given a biometrics valid for 30months from their nearest post office.

That's unfortunate. It would undermine D-ECP, where the maximum is thirty three months.

TA sensibly lead to twenty seven months and subsequently thirty three months validity periods.

It would have made more sense for them to issue a three months vignette instead of thirty days, so as not to undermine TA.
