EU trip for UK born Indian baby?

Post by Somil » Mon Jan 15, 2018 10:31 am

Dear Team
Me and my wife are in UK on ICT Tier 2 visa. My baby boy was born here in UK 9 months back and we got an Indian passport for him from Indian Consulate and that's the only document he is having (No Visa or BRP).
We are planning a trip to Paris and Amsterdam and want to know if he is allowed to travel to Europe and come back to UK, on the Indian passport alone or will need some UK visa/ permit beforehand. Kindly help. Thanks
Somil

No he cannot. Being UK born to parents who are not settled does not give him any special rights etc.
or will need some UK visa/ permit beforehand
He will need a Tier 2 dependent visa to re-enter the UK and a Schengen visa, same as the parents.

Many thanks Moderator.
Just to be doubly sure, I will need to have a ICT Tier 2 dependent visa processed for the baby, from the Indian embassy/ Consulate, before I can apply for Schengen visa for all of us. Kindly confirm.

Thanks Again

Indian Consulate has nothing to do with Tier 2 visas. You have to apply to Home Office for a Tier 2 ICT dependent visa, either by post or in person at premium centre. Only then can you/spouse/child apply for a Schengen visa.

Ok, great. My confusion is cleared. Can't thank you more.
As I checked, getting an ICT tier 2 dependent visa processed for baby born here in UK will cost me over £900!! , that's enough to jeopardize my travel plans as this visa is not a pre-requisite for travelling back to India (after finishing my assignment here). One last thing I request you to kindly confirm

Just thinking, but then your child is staying in UK without proper visa/right to stay

Not sure how long that is valid....worth checking this

Yeah. That again is a point that how long is he entitled to stay, just on the Indian Passport, without Visa!

How long do you have a visa valid for?

When do you plan on returning to your home country?

If you are leaving by beginning of May, then no need to apply for a dependent visa while you are still in the UK.
