Hi everyone

My husband will soon be applying for ILR as a spouse of a person present and settled in the UK (that would be me, I'm a British Citizen from birth).

We are under the 5 year route and both previous visas (LLR and FLR) were both granted as spouse. But now we have a baby, who was born here in the UK and is classed as a British citizen.

So I just want to check that my husband can still apply for ILR using SET(M) as a spouse. And as far as I can see we do not have to fill in Sections 2C and 3 and in Section 8A (Financial requirement) we do not have to take the baby into account, is this correct?

Sorry if these are really obvious questions, but with the visa costing a breath-taking amount we really want to make sure we know we are filling in the right forms. Such a stressful time as you all know!

Correct form yes. You need to complete question 3.6. Section 8A - correct, a British child is excluded from the calculation of the financial requirement.

Thank you so much for your reply, very reassuring to know we are still on the right path!

The wording of Section 3 is really confusing me. I had read it that it was only for children that are also applying for the visa.

Would we also complete Q3.1 to 3.3 as well? And for Q3.6 our baby does not have a passport or speak yet, so do we just leave those boxes blank?
