FLR(M) Application time - Right To Work

Post by Stoner1 » Wed Jan 17, 2018 9:55 pm

Hi guys, looking for some advice. I have recently applied for the extension of my current spousal visa. I have provided my work with my acknowledgment letter and biometrics letter and also my payment details. I have also urged them to use the employer checking service which they haven’t yet. They haven’t accepted any of these forms of evidence to day my application is going through an I still have the right to work while my application is pending. Is there anything else I can do? I’m desperate. They have put me on leave without pay and given me a 28 day grace period. If I can’t show them I can work while this is pending my employment will be terminated

If you had a right to work in UK and you have applied for extension before your visa expired your employer can not just terminate your contract, it is against the law, every big company have there HR dept who deals with these situations you should contact them.

If you submitted your application before your visa expired, you are covered under Section 3C of the Immigration Rules. Google that and show your employer and advise them that terminating you could be classed as an unfair dismissal.
