Spouse Visa - Wife committed adultery & pregnant from sin - what are my options...

Post by azeem23 » Sat Jan 20, 2018 12:35 pm

Hi All, I have turned to you for help and advice...
I came to the UK on 8th April 2010 as a student and then married to a British citizen on 30th September 2013.My initial spouse application got rejected due to earning. However, the first tribunal allowed the appeal. Home office challenged the decision and my application rejected.I made a fresh application within 28 days of grace period after the court decision and got my Spouse visa on 19th April 2016. Life was coming to a track until she cheated me and got pregnant with someone.
I am disgusted with the whole situation and wanted to divorce her.I left home since she committed adultery and seeing someone from the last couple of months and I have my future plans with her.
All Gurus - I am seeking your advice about what options I have and can i stay in Uk if I divorce her?
My new girlfriend is willing to help me and can marry me now.
My question is if I divorce now will I be classified illegal and if so, can I marry my new girlfriend while being illegal?
Or any other options i have as it will be 5 years in September since I got married to the British citizen.
Please, guys, advise me what should I do, I am heartbroken and confused.

Eagerly waiting for your advice.

Maybe it’s a silly question but what makes you think that child is not yours ?

It is the British spouse that has to inform HO as they are the sponsor for the OP on a spouse visa.

Thanks CR001. The wording in the first part had led me to understand otherwise.
