Pension Income

Can pension income alone be used to meet the financial requirement? Or does it have to be combined with one of the other categories?

Also can an American citizen who has entered on a 6 month visit visa be allowed to apply FLR M outside of the rules on compassionate grounds - husband is terminally ill and she is his full time carer. He could possibly die if she were to return to apply for entry clearance

I would imagine if the pension of the sponsor is sufficent and at the required level, then yes.

The 'visitor' won't qualify for FLR(M), it will be refused.

FLR(FP) 10 year partner route might be possible, difficult to get though and current waiting times is around 6 to 12 months.

So just to clarify, state pension £8,767.72 plus private pension £18,189.72 together amounting to £26, 957.44 is sufficient?

I’ve read through but just not too sure on a couple of things
Is only one bank statement sufficient?
Also the DWP state pension letter is dated March 2017, is this too old
It seems the supporting documents are not many which seems quite strange- either that or I’m reading it wrong 😬

As I have already said, FLR(M) will fail.

She needs to apply FLR(FP) 10 year partner route which has no income requirement. It might also be refused.

Just to report back on this one, the lady was granted 2.5 year visa on 10 year route as a partner under GEN 3.2.

Just wanted to confirm whether she could still apply under this route for the bereavement spouse visa if anything happens?

Just to confirm the exact wording:
You applied for LTR under Appendix FM-5 year partner route. We consider under GEN3.2 that there are exceptional circumstances which would render refusal a breach of Article 8, taking into account the helath of your partner.

Accrodingly you have been granted a period of 30 months limited leave to remain on the 10 year partner route under para D-LTRP. 1.2 of Appendix FM.

It goes onto say she does meet the 5year partner route because she was without valid leave and was refused leave to enter. Her application does not meet requirements of GEN.1.11A and her grant of limited leave is therefore subject to a condition of no recourse to public funds.

Does this mean she will still be able to apply for a bereavement visa if and when her husband dies?

Vinny or can anyone else advise on the above. Her spouse sponsor has just passed away. Would she. E able to apply for indefinite leave to remain on the basis of bereavement

In her situation probably best for her to get advise from a professional immigration solicitor
