Quit UK Tier 2 sponsored job | New job in hand

Post by ediston » Sat Jan 27, 2018 1:09 am

Hey guys

I am so sorry if this has been asked (I checked a lot but none of the answers my question).

Facts:
1. I came to London on 30th Oct. 2017 working for a salary of 81000 annual
2. I had to quit my job(personal reasons) on 11th Jan. 2018
3. Got a new Job, A* sponsor, on 26th Jan. 2018 for a salary of 70000 annual
4. I have not received the curtailment letter yet
5. I know the new sponsor is an A* sponsor checked here, but I am not sure they have licenses available
6. My job is on the shortage-occupation-list
7. I am very stressed , I have to visit my country at the end of Feb.

Questions:
1. Would I need a sponsorship transfer or would I have to apply for a new visa from scratch i.e. provide proof of english again?
2.a. If my new sponsor has a license, how fast the whole process can be done as I plan on visiting my country at the end of Feb., 2018., if new sponsor have license available
2.b. How long , if new sponsor does not have CoS license available
2.c. Or CoS has to be applied in any situation?
3. Does my salary difference has any problem?
4. I read here that for a salary of 73900 or more RLMT is not required. Is this correct?

Useful if you stated what category of Tier 2 visa you came to the UK on??

1. New visa, change of employer, meeting all the standard requirements.

2a. Not sure
2b. A couple of weeks
2c. You have to have a CoS for a new visa with a new sponsor.

3. Should not be an issue provided it meet the requirements of the SOC.

4. RLMT not usually required for Shortage Occupation, but again, depends on what category tier 2 your current visa is. What is the SOC of the job you are being offered.

Tier 2 General

SOC = 2136 , assuming SOC = 'Shortage Occupation Code'

Not all jobs under 2136 are shortage occupation. What is the job title/role you have been offered?

SOL = Shortage Occupation List

SOC= Standard Occupational Classification

Yes. I have an experience of 5 years.

Quick question: As I said I was working till 11 Jan.
And currently I have a new sponsor.

Do I have to apply for the BRP with all the documents again?
e.g. English language documents?

Best regards
Edi

You need to apply for a new visa with your new sponsor.]

As I said, only certain jobs under SOC 2136 are shortage occupation, hence my question on what it is exactly you do and industry, as per the quote I provided.

Correct me if I am wrong:
I think there are three categories there:
  1. Senior developer employed by a qualifying company, in a role which requires five years of appropriate experience, as well as proven experience of team leadership
  • 2Programmers and software development professionals in visual effects and 2D/3D computer animation for film, television, or video games industries:

    Software developer
    Shader writer
    Games designer
  • 3Programmers and software development professionals in the electronics system industry:
    Driver developer
    Embedded communications engineer
I am in the first category.

Please let me know that do I have to re-apply from scratch ?

Not sure what you mean by 'do I have to apply from scratch'. Yes you have to apply for a new visa if you are changing sponsors once you have a CoS and the online system will tell you what you need.

What I meant is do I have to apply for a BRP from very start?
Do I need to submit proof of english again and all those things?
Is it a fresh application for BRP? I already have a BRP (which will be curtailed soon)

You apply for a new visa, which comes in the form of a BRP if approved.

You need to score all the same points again as far as I understand.

Hi

Thank you for answering the question. My new employer will apply for CoS today and they will have it ready by 12 or 13 Feb.

Please let me know how to apply for the new BRP? Is there a wiki on this?
Please remember I still have my current BRP.

Thank you so much

You apply for a new VISA it is not just a BRP application (which is another type of application for only a BRP card).
