ILR - 180 days of absence

Post by balavbe1 » Wed Jan 31, 2018 2:38 pm

Hi there,
My question is related to the ILR application - 180 days of absence in any continuous 12 months period.
I travel abroad for projects (4 days a week), typically i leave the UK on Monday morning and comes back on Thursday evening. therefore the absence in the UK is considered as 4 days (Monday to Thursday) or 2 days (not considering the part day absences, less than 24 hours)

Regards,
Bala

2 days (not considering the part day absences, less than 24 hours)
You do not count date of departure and date of return.

Hi CR001,
in the forum some people saying you have to count date of departure and arrival as well and some are saying you need to count absence excluding those 2 days...which one is correct, please?

For the absence letter - it is including,.

For the form - it is excluding.

But the application form only requires dates of departure and entry, not day counts...?

I just asked my employer to sign a document with a table of all absences, listed with “date left” and “date returned”...

Aa I suppose CR001 meant that the employer’s letter should state the dates on which you left and returned, but they don’t count towards the 180 day limit. :)

The SET(O) form also asks for dates or arrival and departure rather than numbers of days.

Correct yes, I should have been more clear. You have to state the dates in the form but NOT count the departure/arrival date in the absence days count/total.
