Twins registration

Dear all,

I am on a 5 years Tier 1 Entrepreneur visa and my ILR application will be due in November 2018. My dependants are my wife and my newly born twins who were born in December 2017 in the UK. My wife has a dependent visa valid until November 2018 (until my visa).

My question is regarding my twins. I have registered their births with the local council. Now I have two options:

1. Firstly I don’t do anything and they remain with no status until I get my ILR and after them register them as British thereafter. I know babies won’t be able to travel during that time.

2. Secondly I register their birth with the Indian embassy and apply for a Indian passport. Thereafter just register them as British once I receive ILR.

My question is:

Regarding point 2 above, will they be eligible for British nationality after obtaining Indian passport. Is there any issues registering birth with the Indian embassy and taking a Indian passport. The babies need to travel outside so just wondering if they take Indian passport and returned from India and register British, will there be any problem.

No, not regarding the UK authorities.
The babies need to travel outside so just wondering if they take Indian passport and returned from India and register British, will there be any problem.

Dear all,

I have heard there is a new rule from January 2018 that the 180 days absence in each year applicable to Tier 1 Entrepreneur migrant will also apply to their dependent.

My situation is that I got married in India in January 2017 My wife obtained her dependent visa in April 2017 and she entered UK as my dependent in May 2017. She didn't travel out of UK since then. We were blessed with twins in December 2017.

I am planning to send my wife and twins to India from June 2018 until November 2018. My ILR application is due in November so they can enter UK in November and I can then apply her visa.

My questions if my wife is absent for 5 months this year. will this be a problem? How do they count the calculation of absence each year.

No.
How do they count the calculation of absence each year.
In a 12 month rolling cycle and not calendar months (i.e. Jan to Dec).
