Tier 2 PBS Dependent VISA Failed to Maintain Funds

Post by sureshbabu1102 » Wed Feb 07, 2018 12:35 pm

I came to UK 31st March 2012 on Tier 2 Sponsored and my family came to UK on June 2013 with dependent VISA

I got ILR Last year 2017 Feb 26th my family still in Tier 2 Dependent now their VISA is going to expire
March 31st

I have realized lately to maintain funds to go for PBS Extension after I verify all my accounts and my wife account has funds only for 2 people one kid doesn't have funds to show

I need to maintain funds for 3 dependents so I only have funds 2 ppl.

Shall I get ILR dependent VISA for that child alone

what is the best way to apply VISA for my family before March 31st

Any one can help me regarding this.

They all need to apply for the same category of visa.

Do you have any funds in overseas accounts??

If you don't have the required maintenance funds for the full 90 days (assuming it is 3 dependents), PBS dependent visas will likely be refused. You likely have no option but to change their visas to FLR(M) which will reset their clocks to zero and a new 5 year route (2 x 2.5 year visas) before they can apply for ILR.

Perhaps other members can offer additional advice.

As it is online only, my understanding is that the date of application is the date you apply and pay online.
Date an application (or variation of an application) for leave to remain is made
34G. For the purposes of these rules, the date on which an application (or a variation of application in accordance with paragraph 34E) is made is:
(i) where the application form is sent by post by Royal Mail, the date of posting as shown on the tracking information provided by Royal Mail or, if not tracked, by the postmark date on the envelope; or
(ii) where the application is made on a paper application form and is submitted in person, the date on which it is received at a Home Office premium service centre; or
(iii) where the paper application form is sent by courier, or other postal services provider, the date on which it is delivered to the Home Office; or
(iv) where the application is made via the online application process, the date on which the online application is submitted whether or not a subsequent appointment is made at a Home Office premium service centre.
