Tier1 ILR after 5 years

Hello everyone,

My tier1 extension approved on March 2017. I looking for ILR after 2 years. I want to ask few questions to the respected members specially zimbaa.

1- Is it compulsory for My business to be in profit for coming 2 years? ( please consider my business was in profit for last 2 years)

2-Is there any minimum income or Tax requirements for ILR through this route?

3- My dependants came in UK in December 2014. What visa shall I apply for them in March 2019? How much is the application fee for that dependants application?

3. They will need a tier 1 dependent extension before they qualify for ILR. They will get a 3 year extension.

Thanks zimbaa. Its in policy guidance 11-2016- page 61. But I think it's for those who taken over an existing business. My business is running as normal. Is there anything extra which we need to look for ILR application.

Hello everyone,

My tier 1 initial application was granted in December 2013 and I got my tier 1 extension in march 2017.

I will apply for ILR in march 2019. I have 1 employee working full time (135 hrs/week) from march 2017.

Will this be enough for my ILR application if I keep 1 full time employee till march 2019 or I have to create more jobs??

Please advise.

No one can work 135 hours per week. :)
You need 104 weeks of full time employment since extension approval before applying for ILR.

Assuming you meant 135 hours/month, you are ok with the Job creation.

Thanks zimbaa and marcnath for your reply. That's my mistake :D as I corrected above its 135 hours/ month.

I need some further help. My extension approved on 02/03/2017 and I will apply for ILR on 1st or 2nd march 2019. My current employee working with me from my initial application time.

As I said he is only employee that I have and on the date of ILR application his 104th week will be in process. How can we manage this to avoid any problem.

Please consider I'm paying him on a monthly basis and all his salary slips are 135 hours/ month.

Not sure what the problem is. The requirement is 104 weeks and I assume that will be done on 27/2/2019.
You can generate the payslips and submit the FPS for February early (you can do it in 1st Feb if you want) and submit the documents for your application well ahead of your Visa explry.
And then, just to be safe, once you have the March 2019 documents, you can send in the additional payslip and FPS

Hello everyone,

I'm very thankful to all the members for helping me in past and now in process of my ILR application.

My Tier1 extension visa will expire on 2nd march 2019 and will apply for ILR next month.

1- I lost my company incorporation certificate 🙁. Any solution for this?

2- what will be application date ?
The date on which i submit online application or date of biometric appointment.

3- My initial application was granted in 19th December 2013 and extension on 02/03/2017.
1 employee is working fulltime (135 hours/month) for my company from 1october 2014 till present and I'm using brightpay software for RTI submissions. (I used his working hours for my extension as well)

Will this be fine for job creation requirements?
FPS generated be brightpay and hours.

I'm asking this again just to make sure that nothing is changed. Marcnath and zimba answer this in February last year aswell.

1 - I guess you can always ask Companies House for a duplicate. But this is not a required document for your ILR
2 - Date of online submission
3 - Since you have only 1 employee, you will only complete 24 months on 02/03/2019. While you could apply in Feb on the basis that the employee will continue until 2/3, you should send in the documents as soon as you have them for Feb and March

Yes I'm completing my 24 months of employment on 02/03/2019. But as you said before that i can generate FPS and salary slips at the start of February.
I have an other employee and she is working part time (16 hours/week) from last 4months.

Will that be any good?

Yes, you also need 1 day in march.

You should add the part time worker to be on the safe side - it is not clear if it would be counted but since you are under transitional arrangement it might. And still send in the March pay documents when you have them.

As genuine entrepreneur test still part of ILR application. My question is what documents do we need to satisfy the case worker about genuineness.

Can someone please help me where in the guidelines, it says that we don't need to send business accounts, business bank statement and director loan agreement again after 5 years for ILR.

Can someone share Any successful applicant documents list.

Refer to Table F Tier 1 guidance. No investment documents needed and DL and accounts fall under that which is already satisfied at extension stage.
