Status change for Tier 2 Dependents after the main applicant gets ILR

Post by MM0099 » Tue Feb 13, 2018 5:12 pm

Hi,
I am seeking some advise on this issue.
I am have a tier 2 visa since 2013 and will be eligible for ILR this year. i am getting married next month and will have to apply a dependent visa for my wife in order to bring her here. I want to know what happens when i get an ILR. Do i have to apply for a different dependent visa for her again. her current dependent visa will still be valid ?

Please advise.

Best Regards.
Mahmood

I want to know what happens when i get an ILR.
If she has a tier 2 dependent visa, she can continue on this visa and extend it until she meets the requirements for ILR.
Do i have to apply for a different dependent visa for her again.
No.
her current dependent visa will still be valid ?
Yes. She will however only get a dependent visa with the same expiry date as your current visa.

You don't state when you plan on applying for ILR??

Hi, thanks a lot for your reply :)

i will be applying for ILR October this year and my visa is valid until oct 2019, so does that mean my wife will get a visa until 2019 too and then we will have to renew it ? :)

If she applies BEFORE you get ILR, then yes, she will get a visa with the same expiry date as yours and then she will have to apply for an extension, which will be a 3 year extension.

Okay thanks ! yes she will apply before my ILR.
my only concern was if in this case we would then need to change her visa again after my ILR because her primary applicant's status would have changed from tier 2 to ILR ... but it looks like she can carry on until oct 2019 and then get an extension :)

This was great help :) Thanks again.

If you get ILR on the PBS route with 5 years residence, the immigration rules permit your dependents to continue extending till they meet the requirement for 5 years ILR.

immigration-for-family-members/dependan ... 14832.html

Please note that your PBS dependent will be subject to the new absence limit rules of no more than 180 days absence in ANY 12 month rolling period. This rule change came into effect on 11th January 2018.
