MN1 Section and conditions of stay

Hi All,

I got ILR recently via Tier 2 5 year route. In 2 weeks my wife and my 1.5 year old daughter will apply ILR.

In an year's time, I will apply for naturalisation and my daughter will be eligible to be registered as a British Citizen using MN1 form. My wife is not planning to apply for BC as she has to work for a join project funded by Indian Govt for 2 more years.

My daughter was born outside UK ( in India), May 2016. Applied for Tier 2 dependent Child visa in September 2016 and entered UK by end of Sep 2016.

I have the following questions.

Is she eligible to register as BC only after I get my naturalisation cenrtificate?

In which section under MN1 she falls ? Section 3(5)?

Are there any residency requiements for parents or Child ? Or the absenses are restricted from the UK?

Either apply with you or after you get BC. Your wife must also hold ILR and be settled for the child to qualify.

Section 3(1) for children born abroad.
Are there any residency requiements for parents or Child ? Or the absenses are restricted from the UK?
No and No but child should hold ILR.

Yes. My wife and child will hold ILR at that time.
