Secondment

Hi all,

I have a question about secondments and would appreciate your advice on this.

My current employer (UK based) is looking to second me another employer (also based in the UK) for 1 year. The role I will be doing is different and my salary will be paid by my new employer. In this case would the new employer need to apply a new visa for me, or would my current visa suffice? If a new visa is applied, does this mean that I would be deemed by the home office to have resign from my current employer although my contract is still ongoing?

You cannot work for any other company or get paid by any other company, except your tier 2 general sponsor. What you are proposing is effectively being 'contracted out' to a third party and this is not permitted.

If you want to work for someone else, you will need to apply for a new tier 2 general visa and meet all the requirements.

So does this mean I would need to get my new employer to sponsor my visa? And on completion of my contract, my old employer would have to reapply for my visa?

Also, would this arrangement be fine even though I have an employment contract with my current employer? Would the issuance of a new visa terminate my employment contract with my old employer?

Apologies for the many questions! - my current employer is too very confuse as on what to do!
