Tier 2 General Visa expires before the new one is issued

Post by vgal » Wed Feb 14, 2018 11:18 pm

Hi everyone,

My Tier 2 General visa expires on the 10th of June 2018. I have found another job, and the new employer has started RLMT a few days ago. Unfortunatley, the process is not going to be quick enuogh, because they will be conducting background checks and some other procedures which can take a while.
They are saying the earliest when I will be able to apply for the new visa seems to be the mid of May 2018, but in the worst case it may be delayed, and it is quite probable that my current visa expires before I obtain (or even apply for) a new one.

Moreover, the actaul employer is not going to extend my current visa.

I have a couple of questions:

1) Will I have to leave the UK prior the 10th of June 2018 if I have applied for a new visa by that day?
2) Will I have to leave the UK prior the 10th of June 2018 if I haven't applied for a new visa yet, but having a new COS issued?

Great thanks, highly appreciate your help

If you have not submitted an application for a new visa, yes you will have to leave the UK by the last date of your current visa validity. A CoS issued is not a visa.

If you leave the UK, you are subject to the 12 month cooling off period.
