Set M or Set O form?

Post by pathikvashi » Mon Feb 19, 2018 11:35 am

Hi,

I am naturalised British Citizen ( Tier 1 General). My wife came to UK in Jan 2013 as my dependent on Tier 1 General, I got my ILR in Feb 2015 and based on that my wife got PBS dependent extension in March 2015. Now that she is eligible for ILR (5 year route), little confused which form to use SET O or SET M.

Please advise.

Thanks,

Pathik

PS: apologies if I posted this question in wrong place.

Thanks,

Should I ignore SET(M) which says spouse or civil partner of person present and settled in the UK?

Yes. She doesn't hold a visa in the appropriate category to apply on Set(M) (ie. FLR(M) spouse settlement visa).

If she is a PBS Dependent visa holder, she can ONLY apply on Set(O).
