Married to British citizen but ILR acquired before marriage

Post by mercyme » Mon Apr 24, 2017 7:38 pm

Hi,

I need your advice on application for British citizenship.

Short explanation of my background. I am married to a British citizenship for last ten years and I have ILR which I acquired before my marriage based on four years permanent residency. I am currently self-employed. I have not applied for citizenship due to various property ownership issues in country of origin but I am now ready to apply.

My question is should I apply for the citizenship as a spouse of British citizen or as an individual?

Many thanks.

Whichever way you apply is an 'individual' application. There is no 'dependent of BC' type application.

The only difference is that spouse of BC is a section 6(2) application based on 3 years residence with a max absence limit of 270 days in the 3 years and the 'individual' as you call it application is a section 6(1) application based on 5 years residence with a max absence limit of 450 days in the 5 years. Both have an absence limit of no more than 90 days in the final 12 months.

Both have the same result as an outcome and one is not more beneficial than the other.

British citizenship for discharged bankrupt

Post by mercyme » Wed Feb 21, 2018 9:52 am

Hi,

I am eligible for British citizenship on the basis of being married to a British citizen for ten years.

I went bankrupt in 2009 due to personal circumstances and was discharged within few months in February 2010, so eight years ago. Has anyone been successful in their application when they have applied for citizenship withing ten years of being discharged?

Many thanks.
