Tier 2 Dependent Visa for child, Single Parent Applicant

I have a daughter from a previous partner. We have long been separated and we don't have any sort of communication anymore. But his name is on my daughter's birth certificate as the father. I am currently married to a different man, and I am planning to apply for my daughter's visa. Will there be any problems because he is not her father? Or is there anything extra I need to show to prove that I have full custody of my daughter? Thank you

Two recent refusals for PBS child dependent visas due to other parent not also applying and no evidence of official sole responsibility.
