Spouse Visa Help

Post by seekit » Tue Feb 27, 2018 1:26 pm

Hi,
I've a question regarding my wife's indefinite visa that when will she become eligible for it.

She applied visa from Pakistan and got first visa:
Start: 20 August 2013
Expiry: 20 May 2016
Total Time: 2 years, 9 months

She arrived in UK on 14 Feb 2014 that was about 6 months after visa start date.

She applied for an extension in April 2016 and got a permit with following start/expiry:
Start: 14 June 2016
Expiry: 05 January 2019
Total Time: 2 years, 6 months, 22 days

As you can see there is a gap of about 25 days between last visa expiry and new visa issue. is this normal?

As she first entered UK on 14 Feb, 2014 her 5 years will complete on 13 Feb, 2019 but visa will expire before that i.e. 05 Jan, 2019. Does that mean she'll have to get another extension? Or can she go for ILR direct?

Many Thanks

Hi, Thanks for your reply. Is the gap in visa stamp normal? what was her status in between? I hope this will not cause any problems.
Once the extension is granted can we go for ILR straight after lets say in March 2019?

Many Thanks

The time spent waiting for a decision is counted, so no issue with that.

She can apply for ILR no sooner than within 28 days before 14 February 2019. Her delayed entry to the UK has caused the shortfall.

Hi, I've searched through some of the topics here on the forum and it appears we can apply for ILR if 5 years are completed on the date of decision. Is that right? Or someone suggested we could put an application for extension then vary it to ILR. Can anyone experienced comment on it please?

Many Thanks
