Tier 2 visa refusal due to incorrect COS (Please help)

Post by har1313 » Sat Mar 03, 2018 9:57 am

Dear All,

Hope you all are well.

I just got a refusal letter for the Tier 2 General visa.

Current immigration category: Tier 4 Dependent
Sponsor license: My company applied for the sponsor license to the home office stating that they want to retain me for the job role, RLMT was done and my immigration category was clearly mentioned as Tier 4 dependent and finally HO issues A rated license with 1 COS.

I applied for a visa using the COS and yesterday, I got the refusal yesterday stating that I need restricted COS instead of unrestricted.

My questions is : My company applied for COS telling HO my current immigration status(tier 4 dependent). So why did HO issued me unrestricted COS?

KIndly please advice if i am eligible for the admin review and will they consider my case.

Although my employer has immediately applied for the restricted cos.

Really appreciate your help.

Thanks
Regards

Applying to change from a dependent to tier 2 general for the first time definitely has to be Unrestricted COS and you will have to apply for entry clearance from home country.

Employer has the ability to request both restricted and unrestricted COS.

It is a Restricted CoS the OP needs not an Unrestricted CoS as you have stated.

HI all,

thanks for your reply,

Refusal letter clearly states that i need restricted cos. They states that if i supply the restricted cos they will issue me the visa.

Have applied for the restricted cos on 2nd march 2018 and fingers crossed hope i get it otherwise i might need to go back to india to get the visa ..

Hi har1313,

I have the same issue with you, just got the letter today that my CoS suppose to be restricted, please how did you go about it, any update? Is it wise to apply for administration review or wait till my employer get me a new CoS? But note that they stated in the letter that i only have 14days to make administration review. I will really appreciate your response. Thanks
