Hi there one and all. Just a few quick questions about the NTL application. My wife has ILR and her passport is due to expire in about 7/8 months time. She is working, so as per the rule changes regarding not being able to work on an expired passports ILR stamp, she will need to apply for a BRP quite soon. I just want to ensure that an application can be made before her passport expires? I believe her passport expires in October, can we start the application process now? I have one or two other questions that I’ll ask once I know the answer to this one.

If her current employers had previously checked her valid ILR documents and she is not changing employers, then there is
no requirement for them to recheck her ILR documents.

I see. Yes, her employer has a copy of her ILR on record. When I read the rules I assumed they meant that as soon as her passport expires then without a BRP she would be working illegally, is that not the case? I appreciate members may not know the answer to this question, but what if she gets moved to a new department in the future and they ask to see her immigration status? I guess we could make a premium service appointment to deal with that immediately. Regarding travel, she can travel on her new passport with the ILR stamp in her old passport and carry both, correct?

She is legally working. Her passport may expire, but her ILR status
doesn't,
unless she has been absent from the UK for more than two years.

may travel with both passports as indicated.

Ok, cool. Thanks for the advice! So am I to assume that spending the cash on an application would be a waste of time and money?

Just to confirm though, can an NTL application be made in the 6-8 months before my wife’s passport expires? Or does the passport have to be expired before an application can be made? Just in case we change our minds in the future.
