absences in last year

Post by ENT2KM » Sun Mar 04, 2018 7:29 pm

Dear Seniors can you please explain me what this text in policy guidance means exactly: For settlement applications made from 11 January 2018, we consider absences from the UK on a
rolling basis, rather than in separate consecutive 12-month periods. If your qualifying period
includes time before this date and you believe that this change would cause you exceptionally
harsh consequences, you must set out the reasons in a letter. what is this rolling basis means ? how it apply in my case.
My situation is i will apply for ILR on 31 march 2019. Going back from this date of 31 march 2019, till 31 march 2015, in 4 years i spend over 300 days in each year in UK. In year 5 from 31st march 2015 to 1 april 2014, i spent 169 days in UK, my absences are 191 days in that year.
Is there any 28 days prior to 5 years we can apply thing can be applicable for 180 days also, as after 28 days my absences will be less than 180 days? Please can you tell me what is the right course of action.

It is no more than 180 days in ANY 12 month rolling period. It is NOT calculated counting backwards in 12 month cycles from date of application.
