ILR enquiry

Post by Nsing » Thu Mar 08, 2018 1:13 pm

Hello
My husband first came UK on 2 nd nov 2008( visa work permit 20/10/2008 to 20/10/10) and came back 2 nd dec 2008.
After that he came back 3 rd may 2011(visa tier2(ict) established staff 8/4/11 to 21/4/14)
Again left UK 2 nd may 2011 and came back 16 sept 2013 and extended 3 times
From above date it’s continuously extending visa in UK only leave to remain status

My queries are
1. Can he have possibility of ilr?

2. Can he extend his visa number of times? Or can switch to tier 2 general in country? After tier 2 general is he eligible to ilr?

3.we have child 10.5 year old? Any chance on 7 year child rule?

Are you sure your dates are correct??
After that he came back 3 rd may 2011(visa tier2(ict) established staff 8/4/11 to 21/4/14)
Again left UK 2 nd may 2011 and came back 16 sept 2013 and extended 3 times
Useful to list all the visa start and expiry dates and all the date he entered and left the UK if you expect any useful advice.

As his Tier 2 ICT issued in 2011 was a new grant and not an extension of the previous work permit, he would come under the Rules in force at that time, which does not put ICT visa holders on the pathway to ILR. But some people (primarily those who had switched over to Tier 2 G) have been lucky.

What is your status? Are you a British citizen, on ILR or on another PBS visa? Could you sponsor your husband?

No Iam his dependent and can he switched to tier 2 general because his tier 2 ict application made in March 2011?
From sept 2013 we r continuously staying on ict 2011 visa so can we eligible for 10 year ilr route?

I will leave it to others to advise you further on the nuances of Tier 2 ICT visas and ILR, as I understand that there were some rule changes in both April 2010 & April 2011.

Can you let us know the dates of application (not the dates of grant, but the dates that the applications were submitted) of the various visas?

Work permit visa application made aug 2008 (exact date I don’t have)
Tier 2 ict application made March 10 th 2011 and also
He is working under same employer from 2008 till now..
And also gap between workpermit expiry date and tier 2 ict visa grant is nearly 4 months
Thank you once again for your inputs
