Curtailment letter received after the date due to change of address

Post by Bernny » Fri Mar 09, 2018 4:54 pm

I had my tier 2 visa cancelled and I packed out of my former address but still waiting for my curtailment letter on the address. It was sent in December 2017 to inform me that my leave to remain will expire on 9 Feb. The landlord delivered the letter to me on 13th Feb unfortunately, I am yet to obtain my COS from my new sponsor.
Please what is my fate in UK with the condition
Can I contact the HO to inform them that I received the letter late. Thank you

many people have had a similar issue in the past with varying outcomes. As it stands you are an overstayer and that might lead to your next application being refused or delayed. AS far as UKVI is concerned, you have been served your curtailment letter and the curtailment period has now expired. You can search the forum for a similar issue and possibly wait for more responses here.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

It is your responsibility to inform HO if your address changed.

The curtailment letter was sent and delivered to the address they had on their system, so unlikely you can challenge this by stating you got it late as you failed to inform them accordingly. Why did you not follow up with your previous landlord if you knew there was such an important letter on the way??

As already mentioned, you are now an overstayer by far more than 28 days and it might be unlikely that your next visa application will be approved
