Short of 8 months for ILR application

Post by vinay21 » Sat Mar 10, 2018 4:15 pm

Hi,

Can someone advise the best way forward, my wife came to UK on the 16th of January 2014 and her first visa as a PBS Dependant was from 10.01.2014 to 27.04.2015, next extension given was from 28.04.2015 to 18.05.2018, total period till May will be 4 yrs 4 months, short of 8 months before she can apply for ILR.

Also, in the above period she was away from the country from 22.04.2016 to 2.11.2016 - 194 days, and I have heard there are some new regulation with regards to 180 days out of country rule.

Can someone please advise what visa should she apply for and when will she be eligible for ILR application.

Thanks in advance.

The 180 days only affects applications for extensions or new visas on or after 11th January 2018. It does not affect past absence for existing visa holders.

She will qualify for ILR end December 2018/January 2019. She will need to apply for a PBS Dependent extension, which will be a 3 year extension.
