Tier 2 ICT 5 years ILR rules

Hi,

I've been in Tier 2 ICT Long term for about 4.5 years. Can I apply for ILR after 5 year completion. My first visit to the UK was on March 2013 and I have ever been in the UK with a little break to my home country (India), but the break has never been over 3 months.

No you cannot. ICT visas issued after 6 April 2010 no longer qualify for ILR based on 5 years residence.

Thanks for the prompt response.

Is there any other options to settle down in the UK? By converting to other visa types. I have heard people switching to Tier-2 General, but I am sure what that requires to make the switch. Any info on this would be appreciated.

You cannot switch to Tier 2 General without the cooling off period and for this you would have to find another sponsor.

You could look at a student visa or if you have a dependent spouse, maybe they can get a Tier 2 general and you switch to their dependent.

Tier 1 Ent also if you have access to substantial funds and a viable business plan, but it is also a heavily scrutinised visa due to substantial abuse.

Hi,

Please assess my condition below. I am an Indian national.
  • I came to UK on May 2013 on ICT Tier 2 Short term valid for 1 year.
  • Left UK on May 2014 before my 1 year validity expired
  • Returned back to the UK on September 2014 on ICT Tier 2 Long term valid for 3 years
  • Extended my ICT long term to another 2 years on September 2017 when it was about to expire. This extension was done whilst I was in the UK.
  • In the above period from May 2013 I have never left the UK for continuous 6 months. Note that I left Uk on May 2014 and returned on Sep 2014 - i.e., no gap of more than 6 months.
  • By May 2018, if I count my 1st year on ICT short term, I will be completing 5 years continuous living in the UK
My questions are:
  • Am I eligible to apply for Indefinite to Leave?
  • What are the terms? Should it be the same sponsor or can i move to another company?
  • What about dependants? I have a wife and a kid, but they did not live like me for 5 full years without a break of less then 6 months. They had to live outside of UK in India for about 8 months once when my wife gave birth to the kid.

ICT visa issues after 6th April 2010 no longer lead to ILR, so no, you don't qualify.

Your dependents cannot apply for ILR based on 5 years residence either if you can't.

The advice hasn't changed since you asked the same question last year (topics now Merged)
