Separation if on FLR Spouse Visa

Post by Sunburst999 » Mon Mar 12, 2018 10:59 am

My non-EU wife who is currently in the UK on a Further Leave To Remain Spouse Visa and 1 year away from being able to apply for ILR, has started suggesting she might 'like to apply for the ILR Visa herself'. There are no problems with our relationship. I think she wants to stay in the UK because she has a job here, but would rather do it now as a single person after 4 years with me. Not because I've done anything, just because it would suit her to be single...if she had an ILR Visa. I'm afraid it's the old 'married you for a Visa' cliche which I had hoped didn't apply to her, but it obviously does. She obviously hasn't thought it through, because if she ends our relationship just to suit herself, her Spouse Visa would be curtailed and she could be deported. (I haven't bothered telling her that yet).

What I have questions about, is the other ways she could re-apply for another Visa to stay here on her own. From what I can gather, private life - no, because she hasn't lived here long enough (3.5 years), as a parent of a UK Citizen child - no, because we don't have any children together, a tier 2 Work Visa - no, because her job is not a skilled job and does not meet the minimum earnings requirement of £30,000, Settlement - no, because she's not been here 5 years.

In short, if she wants to just walk away for no reason other than she's bored or wants to be single, it appears she will not be eligible for any other Visa, which means she will have to leave the UK or be deported? Can anyone advise please if all of what I have written here is correct?

Thanks.

She will have no other means to stay on her current route if you report your relationship is no longer subsisting. She would have to find a visa she qualifies for or leave the the UK.
