Tier 2 General Switch

Hi,

I've read most of the topic in Tier-2 General and thank you for everyone's contribution so far.

I'm hunting for information about Tier-2 General switch. Although, it's a pretty straightforward one there are always little nuances in the way.

Until this January 2018, I was on Tier-2 ICT in place before 6th of April 2011. I have got a job offer in the UK and have applied for Tier2 General and with their CoS and application has been successful and I'm due to start on 2nd of April 2018. I can't start with them on the 2nd, so they're going to send UKBA notification for a 28days delay start.

There are a number of questions I have at the moment, because of circumstances that have surfaced just now.

1) Can I go back to my old Tier-2 - ICT visa: Has the new Tier 2 general superseded my old visa and is it not valid?

2) Can I switch to another CoS provided I have another job: The new Tier-2 CoS hasn't started yet, so at this point can I change sponsors on Tier-2?

3) What is the maximum number of days a CoS start date can be postponed?

4) My wife is still on Tier 2 ICT dependant - Will this Tier-2 general switch affect her?

No, your ICT visa will have been cancelled when the Tier 2 General was approved.

Yes, provided it is not your ICT sponsor.

I have delay my start date of the CoS. Somewhere in this forum i read about the employer using SMS system to inform UKBA about the change of dates, after leave to remain is issued. Is there such a period which you're aware of?

23.8 The start date given on the CoS must be the date that the migrant is expected
to start working for you at the time the CoS is assigned.
If such start date for a Tier 2 (General) migrant is subsequently changed after
leave has been granted, it must be within 28 days from the later of:
• the date on which their entry clearance or leave to remain is granted
• the start date on their CoS (taking into account any changes to start date
properly reported before leave is granted)

This is the information I was trying to find. The CoS start date issued to me falls on Bank Holiday Monday, so technically I can't start on that day. So, I hope my new employer is able to send the new date via SMS system that home office communications employ.

One final question though:
4) My family lives with me in the UK and are still on Tier 2 ICT dependent VISA, which theirs expire in Jan next year. I believe the change in my visa from 'Tier 2 ICT Established staff' to Tier 2 general doesn't invalidate their VISA's. Also, I would need to apply for T2G dependant when their current VISA's run out, and they can be in-country while submitting the application.
