Naturalization application for spouse

Post by billi206 » Tue Mar 13, 2018 2:49 pm

I have been granted ILR based on Tie2 General route, 6 months before my wife was granted ILR as Tier2 General/PBS dependent. I will be able to apply for BC in 5 months time after completing 12 months ILR requirement. Would my wife be able to apply for Naturalization based on 6(2) spouse of BC route? In short we want to avoid her waiting 12 months after her ILR and apply immediately as soon as I am granted BC. We have compelling reasons to leave UK temporarily ( 1-1/2 years) for another job outside UK and want to complete this process once and for all.

I have read the FAQs for BC section and found a relevant answer but if someone can substantiate this claim with rule/document from Homeoffice.

PS: I have consulted a Immigration lawyer who suggest she will not be able to apply under spouse of BC as she was not granted ILR as a spouse of BC but as a dependent of Tier2 General and she has to wait for 12 months after ILR.

Yes, provided YOU are British at that point.

Your 'immigration advisor' is wrong.
