Can a company(est. by T2 dependant) be my Tier 2 sponsor?

Post by kumar114 » Wed Mar 14, 2018 10:43 am

Hi,
My friend who is a Tier 2 Dependant established a company here in London in 2013.
When I asked him if his company can sponsor me for Tier 2, he told me that he cannot since he is not a british citizen and his company is a small company.
How true is this?

Kind Regards
Kumar

Read the sponsorship guidance and what is entailed, including costs.

You have posted about changing sponsors, applying for Tie 4 etc. My guess is you are either trying to reach 10 year residence or trying to avoid the 12 month cooling off period.

You cannot manipulate a situation to extend your stay in the way you want to. A company, friend or not, must be an approved sponsor and have a genuine vacancy and follow the RLMT process and pay a minimum of £30kpa.

Perhaps your 'friend' said that as they don't wish to be a sponsoring company and get involved or feel they don't qualify for whatever reason.

Yes. I am trying to reach 10 years. Is it a wrong thing to do?

No, nothing wrong in doing that, but you should not be trying to find loopholes or to manipulate things to suit your needs. For ILR based on 10 years, it is not enough to just hold visas for 10 years, you must have met the requirement of each visa and not be in breach in any way.

Find a genuine visa that you qualify for.

Your 'friend's' business might not even qualify for sponsorship and they will have to pay the associated fees too and £30k plus in salary to sponsor an employee, which for a small company is often not worth it. Any vacancy also has to be a real one and not simply to 'help a friend'.
